New lawsuit formed to recover damages lost from aborted Jackson club

JACKSON, MI (WLNS) – A controversial business in Jackson County is fighting back.  The dispute centers around the use of an abandoned building.  The piece of land about the size of 10,000 square feet is a sore spot in the community.

Creating a club in Summit Township has been a long headache for owners of the Epicurean Development team.  Another lawsuit was filed Friday, this time for relief from damages lost.

In February 2015, Kent Tyler of Epicurean Development decided to put in a permit to Summit Township to make this into a “swingers club.” The former gymnastics studio sits vacant one year later.

Now, the lawsuit refers to the club as a private membership adult couples social club.

I spoke to one Attorney representing the developers.  Frederick Lucas claims members of Summit Township changed the rules after Epicurean acquired the property and the zoning ordinance.  Lucas wants “fundamental fairness.”

Attorney Will Fahey representing Summit Township in the lawsuit says he cannot comment because the Township has not seen the suit yet.

Summit Township Supervisor Jim Dunn declined comment.  He is mentioned in the lawsuit against the Township as unlawfully serving a stop work order on the front door of the property.

Homeowners close by the 4200 Spring Arbor Rd building declined to speak their opinion on the matter.

Zoning Board of Appeals Chairman Retired Judge Charles Nelson during a November 2015 ZBA meeting said that just because it has the word club in the name does not mean it can be recognized as a club.
