UPDATE 1:50 p.m. – Closing arguments have begun in the Martin Zale trial. Earlier today Zale took the stand in his own defense. Zale testified that the Derek Flemming came up to his vehicle and hit Zale in the face while the two were stopped at a red light. That testimony, according to our media partners at WHMI, would contradict earlier witnesses who said they never say Flemming strike Zale.

(WLNS) – The prosecution has rested its case against a man charged with open murder in a Livingston County road rage trial.

According to our media partners WHMI, Martin Zale could possibly testify today as his defense begins. Zale is charged with the September 2 shooting death of Derek Flemming during a reported road rage incident that had escalated.

On Tuesday the prosecution presented testimony that included audio recordings made while Zale was in custody. In one of the calls Zale is speaking with his wife Gretchen and she tells him that he “should have just drove off”.
